How I sued Mouzenidis.

1. I unreasonably trusted Tatyana Nefedyeva, the GrandTourVoyage travel agent, who positions herself as a specialist in Greece, in fact, she does not know Greece at all. Is that some narrow segment. Which sold me a package tour from Muzenidizs, passing it off beyond my dreams.

2. Just as unreasonably relied on the words of the agent that even the wishes of the tourist not included in the contract would be fulfilled sacredly. And they cannot be included in the contract, because the contracts are typical. And who makes additional conditions in standard contracts? Perhaps only super-conscientious contractors. But this is not about Mouzenidis, by the way. And not about the Grand Tour Voyage, to the heap.

Have you ever tried to introduce your own conditions, for example, into bank agreements? Well, it's the same here.

3. The tour was bought six months before departure. The so-called "early booking", be it amiss. On burning tours, and then at times it was better to go. The truth is NOT with Mouzenidis.

The tour cost about 3 thousand euros.

4. Flight conditions changed on the go. Now we fly with one company, then another. Moreover, the agent, until she was poked, did not even know about it.

5. Finally, they flew. And - oh-pa! We were delighted - 3 days before the end of the holiday, we are moving to another hotel located in another locality. Amazing happiness. Naturally, no one told us about this at home. Well, it's understandable - there was just nothing - six months. Did not have time. Happenes.

6. The room we got was "amazing" for its comfort and the view from the windows - to the garbage heap and the crossroads. On the third floor without an elevator. With a heart-rending smell of sewerage and holes from pipes in a shabby bathroom. And the fact that we asked not higher than the 2nd floor or with an elevator, overlooking the sea or the garden, and warned that one of us is asthmatic and suffocating odors are contraindicated - so the same conditions were not included in the contract.

As for the promises to fulfill all the desires of tourists, well it was BEFORE they received the money. And then it doesn't count anymore. I must say that there were only 4 rooms overlooking the garbage dump in the entire large hotel. One of them, of course, had to be slipped to people who booked and paid for the tour for six months. In response to our claims, we were offered to move to the basement floor, which we also gratefully refused.

7. In response to our demands to solve the problems immediately, and if we were to move, then now - until we unpacked our suitcases - Mouzenidis replied that the company considered its obligations fulfilled and could not help us with anything else. The travel agent who was called to Moscow promised to try to resolve the issue, but of course did nothing.

8. The next day, Mouzenidis again said that he was unable to help us, because they could not offer equivalent hotels.

In response to our proposals of a bunch of equivalent hotels in the same village, they replied that they were not in legal relations with them and could not relocate us there. The only option they can offer is to find us other hotels that cooperate with Mouzenidis. And we found. The hotel was 1 star more, and of course we were required to pay extra. Not a lot - not a little - 390 euros. And we agreed. Because you won't wish your enemy to live in anticipation of moving.

9. Having moved to another hotel the next day upon arrival, we thought that our ordeals were over. The hotel was beautiful, if modest, the staff there were wonderful, and it was solely thanks to the staff of this hotel that our holiday somehow took place.

But it was not there. Against the backdrop of a fair amount of nervous stress, my asthmatic immune system failed, and I got sick. Who do you think helped us call the doctor? Mouzenidis? Not at all.

Mouzenidis immediately froze from these problems, and offered to solve everything through insurance and to look for a doctor himself who would be ready to serve us for this insurance. But the hotel staff quickly found a doctor themselves, and even offered to take him to a free municipal clinic in Kassandra in case of an aggravation of the situation at the expense of the hotel. Thank God and the medical education of Greece - a wonderful doctor came. His absolutely correct diagnosis and correct prescriptions finally put me on my feet. Dr. Denis - THANK YOU!

10. After the move, we saw an employee of Muzenizis 2 times, during one of which we bought excursions. Everything. Everything else was taken care of only by the hotel staff, without really understanding whether they were obliged to do this for us or not. Simply, they are PEOPLE.

11. And yet we flew back on the wrong airline, which was announced on the tour. Well, God bless her, flew successfully.

12. Back in Greece, I sent a claim to Mouzenidis.

To which she received an answer with the same position - Mouzenidis is a lollipop, and we - we want it to hell. Already upon returning home, I sent them another claim demanding compensation for damages of 390 euros, which arose through the fault of the tour operator, as a result of failure to provide timely proper information. To which I received no answer.

13. Already in April-May of the following year, I filed a lawsuit.

And it began... It began with the fact that in the very first court session, the lawyer Mouzenidis called me a terrorist. I clarified - an extremist, perhaps? Because legal science knows the term "consumer extremism", but not "consumer terrorism". Apparently, for such detailed accuracy, Mouzenidis's lawyers are not qualified enough. But on the other hand, it was enough to divert the court from the merits of the claim and drive the process in a circle, like a donkey after a carrot.

We discussed everything - from our appearance and health, extremist intentions and bad faith to complete villainy, in view of the fact that we - you see - immediately began to collect evidence, while still in Greece. The question of when and where else to collect them was not at all. That is, they poured mud in the process to the fullest, with the tacit approval of the judge.

From session to session, Mouzenidis filed motions to postpone the case, due to the fact that his lawyers were chronically unprepared for the process. But they were always ready to say nasty things about tourists. I must say, the lawyers of the defendants went into the process like a bear - three of us alone. This flattered my professional vanity, but in no way correlated with the procedural equality of the parties. But these are trifles.

Then, in the middle of the process, false documents flowed into the court in a river that TURNED OUT - of course, we were offered a free move, literally to all the hotels in Greece, but we turned out to be maliciously from all the offers. Mouzenidis could not prove that all these hotels were not only allegedly booked, but actually offered to us. But it is also trifles.

And the case ended in the first instance with the fact that the court, refusing my only petition to postpone the case, in connection with my departure for annual leave to a place of rest and treatment in my native Crimea, quickly ruled in favor of Mouzenidis. Moreover, on their part, the following arguments are recorded in the protocol:

- The meeting cannot be postponed, because the plaintiff (i.e. - I) could freely arrive at the court session, interrupting her vacation for a day. (Aha, why not? In August, rushing back and forth from the Crimea - why not, really ?!)

- The meeting cannot be postponed, because by what right did the plaintiff even dare to go on vacation?

- The hearing cannot be adjourned because the plaintiff could have hired a lawyer. (Well, yes, having learned about the last adjournment of the case a week before departure, in the month of August, it is so easy to find a good lawyer, and most importantly money for him, right before leaving on vacation.)

In a word, there can be no question of any professional ethics and business decency of Mouzenidis lawyers. As well as their professionalism. If three of one without forged documents could not win the court - what is there to talk about?

14. I still won the case on appeal. To be honest, we were very lucky with the composition of the court - a panel of three seasoned judges, who obviously cannot be fooled on the chaff, looked to the root and did not deviate from the subject of the claim even a single step.

A clause of the contract was declared invalid, which is contrary to the law, and which allows the travel company to scatter tourists in all cities and towns of sunny Greece at its discretion. They decided to recover 390 euros of real loss, a legal penalty, and rolled a fine in favor of the state to the heap. Low bow to you, Dear Court.

Summary. If it was so difficult for me, a professional lawyer with 20 years of experience, to win this case, what can we say about other normal people who have nothing to do with jurisprudence? After all, no matter how much you actually pay a lawyer, in practice the court is more than 10 thousand rubles. does not seek legal aid. And it costs a lot more. Evidence on the spot to collect, too, not everyone will guess, and even being on vacation, in a relaxed state. For myself, I decided - I will never contact any travel company at all again.

Nowadays, it is quite free to book and pay for a hotel room in almost any country in the world, to buy air tickets and insurance yourself, without overpaying commissions to unscrupulous travel agencies and operators. What do you want.
