Are the actions of the tour operator legal?
In April, we signed an early booking agreement with AnexTour for a vacation in Turkey in August. The cost of the tour in the contract is indicated in rubles. Made an advance payment of 30%. The manager said that the final surcharge must be paid 3 weeks before departure. Today I called up the manager and heard the following news: the additional payment will need to be made with a conversion to the current dollar rate. It turns out that we have to pay more than the remaining amount under the contract (by 5 thousand) I ask, on what basis? the price of the contract is indicated and fixed, that's why it is an early booking .. I hear the answer that this rule on recalculating the amount appeared only a month ago and is associated with a sharp increase in the dollar. Complete chaos. I will try to reach out not to ordinary managers, but to someone from the management in order to solve the current situation

Hello! We booked this year in February at the end of May, also through ANEX. I can only say one thing, with early booking it is better to pay 100%, in this case, it turns out that the tour has already been completely bought from you, and not one tour operator or the agency will not be able to demand anything from you, since everything will be documented, exactly the amount that was on the day of booking, this was advised to us by the tour agent herself. And in your case, you paid only 30%, which is why they twist, although not legal. But they know that you will not go to court. True, I don’t remember what it says in the contract, it seems that there is something like there, at the expense of unintentional changes, I can’t say for sure now !!!!!

Yes, it's legal. If you made an advance payment, and the dollar rose by more than 0.3% before your final settlement, then a recalculation is made. Well, what's interesting is that if the dollar falls, then there is no recalculation down!

With us, at the last payment, everything is always recalculated at the exchange rate on the day of calculation! If the rate has risen, the cost of the tour increases accordingly, if it has fallen (and it was), the tour is also recalculated. Surprisingly, for early booking you were given a big force majeure payment, our agencies immediately take 30% before requesting a booking, and after confirmation within 3 days they ask you to pay for the tour in full. True, once there was a similar situation in terms of installment payment with Pegasus, but while they were dragging on, the tour also went up in price by 7 thousand (then they flew to Thailand).

In fact, for the first time I hear that "the final surcharge must be paid 3 weeks before departure." Usually, the full cost of the tour is paid BEFORE THE END OF THE "EARLY BOOKING" PROMOTION, which ends at different times for all TOs, but as a rule, before March 1, before April 1, and (there are exceptions!) Until June 1. They are trumpeting and writing about it everywhere!!!

I agree to pay off the rest of the payment at the current dollar rate (I looked at the contract, we paid not 30, but 45% in advance). After all, we paid these 45% at the rate on the day of payment. It is wrong now to recalculate the entire amount of the contract for the current exchange rate.

And, apparently, no luck with the manager who made out the contract. She was supposed to warn about a possible situation and give us the right to choose when to pay: immediately or in 3 weeks. before departure!

If there is a contract and the price of the tour and the terms of payment are written in rubles, then it is absolutely illegal, even if you booked a tour 2 years in advance. With such an early booking, as in your case, the TA will not lose, and here only the elementary greed of this TA is manifested. and the fact that this "recalculation rule" appeared a month ago has nothing to do with you, since the contract was concluded earlier. Although something tells me that you do not agree, and the price of the tour in the contract is indicated in dollars, or these special conditions for recalculation are indicated at the end of the contract. Read carefully.

The price in the contract is specified in rubles!!! The agreement was signed in April. Our only mistake is that we trusted the manager, who, despite the fact that the contract specifies the deadline for the final payment in tech. 3 days, assured that we can pay the remaining amount for 3 weeks. before departure (without warning that recalculation is possible due to the growth of the exchange rate ..). But at the same time, there are no penalties in the contract for the delay in the final payment. Learn from mistakes! This will not happen again in the future!

And in general, we have a thrash situation. The travel agency picked up a tour, chose the hotel you liked, gave the documents, signed the contract, made a payment of 50%. And a day later, the same manager tells us that we need to pay another decent amount, saying that the tour operator did not confirm the reservation at that price. How this is even possible, I don't understand. At least they warned that the cost of the tour may change after payment and online booking.
